DMCA Policy – NovaNext Club
Effective Date: September 14, 2025
NovaNext Club (“we,” “us,” or “our”) respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act (DMCA). This DMCA Policy explains the procedures for addressing copyright infringement claims on our website, https://novanextclub.es/ (the “Site”).
If you believe that your copyrighted work has been used or displayed on the Site in a way that constitutes copyright infringement, please follow the process described below.
1. Reporting Copyright Infringement
If you are a copyright owner, or authorized to act on behalf of one, and believe that material on the Site infringes your copyright, you may submit a written DMCA Notice of Alleged Infringement (“DMCA Notice”) to our Designated Copyright Agent.
The DMCA Notice must include the following (as required by 17 U.S.C. § 512(c)(3)):
Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, including registration details (if applicable).
Identification of the Infringing Material: A description of the material you claim is infringing, including its location on the Site (e.g., a URL) sufficient to allow us to locate it.
Your Contact Information: Name, mailing address, telephone number, and email address.
Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
Statement of Accuracy: A statement, under penalty of perjury, that the information in the DMCA Notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Signature: A physical or electronic signature of the copyright owner or an authorized representative.

2. Our Response to a DMCA Notice
Upon receiving a valid DMCA Notice, we will:
Promptly remove or disable access to the allegedly infringing material.
Notify the user who posted the material (if applicable) that it has been removed or disabled.
We also reserve the right to remove or disable access to material we believe, in good faith, to be infringing, even without a formal DMCA Notice.
3. Counter-Notice Procedure
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a written Counter-Notice to our Designated Copyright Agent.
The Counter-Notice must include the following (as required by 17 U.S.C. § 512(g)(3)):
Identification of the Material: A description of the material that was removed or disabled and the location where it appeared before removal (e.g., a URL).
Statement of Good Faith Belief: A statement, under penalty of perjury, that you believe the material was removed or disabled due to mistake or misidentification.
Your Contact Information: Name, mailing address, telephone number, and email address.
Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., the U.S. District Court for the Northern District of California), and that you will accept service of process from the person who submitted the DMCA Notice or their agent.

4. Our Response to a Counter-Notice
Once we receive a valid Counter-Notice, we will:
Provide a copy to the party who filed the original DMCA Notice.
Inform them that the material will be restored within 10–14 business days unless they notify us that they have filed a legal action.
Restore the material within 10–14 business days if no legal action is filed.
5. Repeat Infringer Policy
We maintain a policy to terminate, in appropriate circumstances, the accounts or access of users who are repeat infringers of copyright.
6. No Liability for Good Faith Actions
We are not liable for damages resulting from our good faith actions in response to a DMCA Notice or Counter-Notice, including removal, disabling, or restoration of content.
